1. Check that the vehicle meets the definition of ‘abandoned’, as laid out in Mississippi code §63-23-5, and comply with the relevant notice and timing rules below.
2. You must notify anyone with a legal interest in the vehicle (e.g. registered owner or lienholder) of your intention to dispose of the vehicle within 10 days of towing the vehicle, and give them an opportunity to reclaim it.
3. In most cases, the owner will have approximately 30 days to respond to the notice. Exact notice rules and timelines may vary depending on whether the vehicle has been left on public or private property, under §63-23-5. In some cities and counties, local nuisance ordinances may dictate the timeline and process for removal instead. Always check with your local sheriff’s office or city hall for the most accurate information.
4. Once the notice period ends and no valid claim is made, you are allowed to sell the vehicle at auction, OR junk it.
5. You must then complete an Affidavit of Abandonment and give all proceeds from the sale (if applicable) to the county.

Step 6: How to junk your car

• If the car is less than 10 model years old, you’ll need to get a new or duplicate title, or transfer it so that it’s in your name (Form 78-006 or 78-026 for the fast track application).
